§ 1 General Information

These General Terms and Conditions (GTC) apply exclusively to all orders placed via the Website and to our deliveries and services in the version valid at the time of your order. Any differing terms of the purchaser shall not be recognized unless we have expressly agreed to them in writing.

§ 2 Conclusion of Contract

  1. The presentation of products on our Website does not constitute a binding offer to conclude a purchase contract.
  2. By submitting the order form provided on our Website, you make a binding offer to conclude a purchase contract with us. You do so by entering all required information during the ordering process and finally sending the order form by clicking the “BUY NOW” button. Before submitting, you will have the opportunity to review and correct any input errors.
  3. Upon receipt of your order, we will send you an email confirming that we have received your order and listing the details of your purchase (order confirmation). Please note that this confirmation does not constitute acceptance of your offer but serves solely for informational purposes.
  4. The purchase contract between you and Marin & Milou GmbH is only concluded when we accept your offer by shipping the ordered goods. For prepayment/bank transfer orders, shipment occurs only after the total amount has been credited to our account.
  5. Marin & Milou GmbH reserves the right to refuse any offer at its discretion, particularly if there is reasonable suspicion that the goods purchased via the internet will be resold commercially.

§ 3 Eligibility to Purchase

  1. To make purchases on our Website, you must provide certain personal information, including your name, phone number, and email address, as well as valid payment details. By providing this information, you confirm that it is accurate and that you are the authorized user of the payment method provided.
  2. The Website is open only to natural or legal persons who meet Marin & Milou GmbH’s eligibility criteria, hold a valid credit/debit card issued by an accepted institution, and whose orders are acceptable to Marin & Milou GmbH. Products should be purchased for personal use or as gifts only, and not for resale, advertising, or other commercial purposes. Marin & Milou GmbH reserves the right to limit the purchase of large quantities of a product or delivery to a single address.
  3. By submitting an order, you authorize us to perform credit checks and to exchange relevant information with third parties, including credit/debit card details or credit reports, as necessary to validate your identity and authorize purchases.
  4. You also consent to the use of your personal data for fraud prevention, which may involve sharing information with credit bureaus and fraud prevention agencies.
  5. Certain features of the Website require registration. All registration information must be accurate, current, and complete. You must notify us immediately of any changes. Please contact service@marin-milou.com. Your account password should be secure and kept confidential. Notify us immediately if your password is compromised.

§ 4 Right of Withdrawal

1. Cancellation Policy

a) Right of Withdrawal: You may cancel this contract within 14 days without giving any reason. The cancellation period is 14 days from the day you or a third party (other than the carrier) take possession of the goods. To exercise your right of withdrawal, please contact Marin & Milou GmbH via letter, fax, or email (service@marin-milou.com). You may use the attached withdrawal form, though it is not mandatory.

b) Effects of Withdrawal, Costs: Upon cancellation, we will refund all payments received, including standard delivery costs (excluding any additional costs for a different delivery method), within 14 days. Refunds are made using the same payment method unless otherwise agreed. We may withhold the refund until we have received the goods or proof of their return. You must return the goods within 14 days, bearing the direct return costs. You are only liable for any loss in value if caused by handling beyond what is necessary to inspect the goods.

c) Exceptions:
The right of withdrawal does not apply to sealed goods that cannot be returned for reasons of hygiene or health once the seal is removed.

2. Returns
To receive your free return label, email your order number to service@marin-milou.com.
Please return items in their original packaging with the included return label, keeping any attached hang tags. Include the original tissue paper, fold items as delivered, and seal the box securely. 3. Repeated Returns
While we aim to offer flexible return conditions, repeated returns may result in us refusing future orders at our discretion.

§ 5 Prices; Product Representation; Availability

  1. Prices listed on www.marin-milou.com at the time of your order apply.
  2. Product images are digital representations; minor deviations from reality are not considered defects.
  3. Orders with multiple items may be delivered in separate shipments.

§ 6 Storage of Contract Text

We store your order details. You may print a confirmation immediately after placing your order. Additionally, the order confirmation email can also be printed.

§ 7 Delivery & Shipping

  1. Worldwide shipping via DHL; Marin & Milou GmbH bears transport risk.
  2. Items are ready for dispatch the next day. Standard delivery: 1–5 business days, depending on shipping method and location. Prepayment orders are shipped after full payment receipt.

§ 8 Payment; Default; Set-Off; Right of Retention

Payment methods: Credit Card (Visa, MasterCard, Amex), PayPal, KLARNA.
Set-off and retention rights are restricted as legally outlined.

§ 9 Pricing

Prices in EUR include applicable VAT. Prices are subject to change due to currency fluctuations or promotional updates. DDP shipments include duties; DDU shipments do not.

§ 10 Retention of Title

Goods remain the property of Marin & Milou GmbH until fully paid.

§ 12 Warranty

Legal provisions apply, except for damages compensation claims as outlined in § 13.

§ 13 Liability

  1. Unlimited liability for intent and gross negligence. For slight negligence in essential obligations, liability is limited to foreseeable damages.
  2. Liability for fraud, guarantees, product liability, and personal injury remains unaffected.
  3. Except for tort claims, liability claims are one year from the statutory start of limitation.
  4. Restrictions apply to employees and agents of Marin & Milou GmbH.

§ 14 No Commercial Use

This Website is for personal, non-commercial use only. Copying, distributing, modifying, or commercial exploitation is prohibited.

§ 15 Governing Law & Validity

  1. German law applies exclusively; UN Sales Convention excluded.
  2. Invalid provisions do not affect the remaining terms.
